Terms of Use of the Website of the Charitable Organization 'Ridni Charitable Foundation

Please read these Terms of Use of the website of the Charity Organisation “Charity Fund “Ridni” (hereinafter referred to as the “Terms”) carefully before using the website of the Charity Organisation “Charity Fund “Ridni” or making charitable contributions in favor of the Foundation online through such website (hereinafter referred to as the “Website”).

These Terms contain important information about your rights and obligations. By using the Website on which these Terms are published, you confirm that you have read the Terms, understand their content, and agree to comply with these Terms in full. If you do not agree to these Terms, please do not use this Website.

The terms ” Charity Organisation “Charity Fund “Ridni”,” “the Foundation,” “we,” “us,” or “our,” as used in these Terms, mean the Charity Organisation “Charity Fund “Ridni” – a non-profit organization (EDRPOU code 38425626, address: Ukraine, 79015, Lviv region, Lviv, 20D Porokhova Street, office 68), which carries out charitable activities through the Website. The collection and use of personal data in connection with your use of the Website is carried out in accordance with our Privacy Policy. These Terms and any rules published on the Website, including our Privacy Policy, constitute the complete legally binding agreement between you (“you” or “user”) and the Foundation governing your use of the Website and the collection of charitable contributions through the Website. By using the Website, you hereby represent and confirm that: (1) you are legally capable and authorized to enter into this agreement under the laws of your country; (2) the laws of your country do not restrict you from using the Website; (3) you comply with these Terms and applicable legal requirements.

“Ridni” is a charitable foundation dedicated to supporting children in Ukraine. We strive to create an environment in which every child feels safe, confident, and happy. We work comprehensively to ensure that every child grows up in a loving family and has a happy future. The Foundation is not affiliated with any political parties, commercial organizations, and is funded by charitable contributions from individuals and legal entities. 

The Foundation’s Website is a tool for carrying out charitable activities under the following programs:

  • Prevention
  • Family-based care and foster parenting
  • Empowering Teenagers and Young People
  • Deinstitutionalization.

The Website is intended for users who wish to make charitable contributions (“Donors”) or otherwise help the Foundation, as well as children, youth, families with children, households, specialists, and communities in need of assistance (“Beneficiaries”).

Support: Through the Website, users can make charitable contributions to the Foundation, which uses them to implement the programs listed above. You may make a one-time donation or regular payments. Users may also send humanitarian aid to the Foundation in a form and amount agreed between the Foundation and the donor. The Foundation regularly provides reports on the use of charitable contributions, which are published on the Website and on the Foundation’s social networks. In addition, the Foundation annually submits a report on the use of income (profits) of a non-profit organization to the tax authority. Please note that payments through our Website are processed by payment service providers we do not control, namely: LiqPay, Monobank, as well as via Patreon, Global Giving, and Whitepay. Once you follow a payment link, you must comply with the terms of use, privacy policy, and other policies of such providers. The Foundation is not responsible for payment data processed by such providers.

Please note that we do not control the exchange rate or commissions applied by your bank. To transfer assistance through our Website or provide humanitarian aid, you must provide information about yourself. Learn more about how we process your personal data in our Privacy Policy.

Third-party services and websites: Some functions of the Website, such as making a charitable payment, involve the use of third-party services and websites not controlled by the Foundation. In case of problems, we will make every effort to resolve them. However, we are not responsible for the content and functionality offered on such sites or by such third-party services, nor for any losses, damages, or other financial liabilities arising from your use of such websites or services. Please note: your use of third-party websites and services is subject to other terms of use and privacy policies. The Foundation is not responsible for personal data processed by third-party websites and services.

Content and intellectual property on the Website belong to and are controlled by the Foundation. All materials on the Website, including texts, images, design, graphics, information, logos, audio and video recordings, interfaces, software, trademarks, trade names, and others (“Content”), as well as copyrights and other intellectual property rights to such Content, belong to the Foundation or are posted with the consent of the owner.

The Content or any of its elements may not be used without prior written permission from the Foundation or the relevant owners in any way not provided for by these Terms. Subject to your compliance with these Terms, the Foundation grants you a limited, non-exclusive, revocable, non-transferable, non-sublicensable license to: (i) use the Website from your personal devices under the conditions set out in this document; and (ii) access and view any Content posted on or through the Website solely for personal, non-commercial use. By downloading or creating copies of the Content, you do not acquire any rights to such Content. You may not reproduce, publish, transmit, distribute, modify, create derivative works of, or otherwise use the Content for commercial or unlawful purposes without our prior written consent. You agree not to alter or remove any ownership notices from materials downloaded or printed from the Website. The Foundation may amend the terms or revoke this license or terminate your access to the Content at any time and for any reason without prior notice. Please note that the Foundation will protect its intellectual property rights by all available legal remedies, including criminal prosecution for serious violations.

Disclaimer of warranties and limitation of liability: The Foundation’s Website is provided on an “as is” basis. Unless otherwise expressly provided by these Terms or other policies on the Website, the Foundation disclaims all warranties to the maximum extent permitted by law with respect to the Website, its functionality, and content.

The Foundation is responsible for the use of charitable contributions in accordance with the applicable laws of Ukraine. However, we make no promises or warranties regarding, in particular, the accuracy, usefulness, reliability, or correctness of the Website’s operation. The Foundation does not guarantee that the Website will be uninterrupted or secure, that any defects will be corrected, or that the Website does not contain viruses or other harmful components. The Foundation is not responsible if any information, materials, or content available on the Website is inaccurate or incomplete, or for typographical errors or shortcomings in the text or other materials. Under no circumstances shall the Foundation, its members, directors, employees, advisors, contractors, or volunteers be liable for any direct, indirect, incidental, special, consequential, or punitive damages related to the use or inability to use the Website, including, without limitation, any damages resulting from errors, omissions, interruptions in operation, defects, viruses, even if the Foundation was notified of the possibility of such damages.

The above provisions regarding disclaimers of warranties and limitation of liability apply to the maximum extent permitted by applicable law.

Indemnification: To the maximum extent permitted by applicable law, you agree to hold harmless, indemnify, and defend the Foundation, our partners, employees, and contractors from any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising in any way from: (i) your breach of any provision of these Terms, (ii) your use or misuse of the Website, content, or functionality available on the Website, or (iii) your violation of laws or the rights of third parties.

You also agree to indemnify the Foundation for any damages and expenses incurred by the Foundation (including fees or expenses of attorneys, accountants, professional advisors, and other experts) in connection with the defense or settlement of disputes arising from your use of the Website for any unlawful or prohibited purposes. We reserve the right to choose the legal remedies we deem appropriate, including in cases where you release us from liability. Therefore, you agree to cooperate with us in implementing our strategy to protect our rights.

Governing law and dispute resolution: Except as otherwise provided in these Terms or any other policies, these Terms are drafted and interpreted in accordance with the laws of Ukraine. If any material on the Website or your use of the Website conflicts with the laws of your location, the Website is not intended for you, and we ask you not to use it. You are responsible for knowing and complying with the laws of your jurisdiction. Any dispute, conflict, claim, or controversy directly or indirectly related to the Website or these Terms, including their validity, interpretation, or application, shall be resolved through amicable negotiations directly with the Foundation’s team in accordance with the principles of good faith and cooperation. If consensus cannot be reached through negotiations, the dispute shall be resolved exclusively in the courts of Ukraine, subject to jurisdiction rules, in accordance with the substantive laws of Ukraine. All claims must be brought within one (1) year of their occurrence, unless applicable law requires a longer period.

Electronic communications: By providing us with your email address through the Website, you understand and agree that we may send you communications to the contact information you provided, including (i) notifications about updates on the Website; (ii) information or materials relating to your use of the Website, charitable contributions, and their use; (iii) information about updates to these Terms. You have the option to opt out of receiving electronic communications from us by following the instructions provided in such communications.

Other provisions: If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the other provisions of these Terms shall remain in force and enforceable. We may assign our rights and obligations under these Terms to a third party, but this will not affect your rights or our obligations under these Terms. A printed version of these Terms is admissible as evidence in judicial or administrative proceedings arising from or related to the use of the Website, to the same extent and under the same conditions as other business documents and records created and stored in printed form. We reserve the right to make changes to these Terms at any time. In the event of a material change that may affect your use of the Website or your rights as a user of the Website, we will notify you of such changes within a reasonable period before they take effect by posting the relevant notice on the Website or sending you an email.
